Granting bail to Arvind Kejriwal will not “demoralise” the Delhi High Court, which last month refused the Chief Minister relief over his arrest by the CBI in the alleged liquor policy scam, the Supreme Court said Thursday. A bench of Justice Ujjal Bhuyan and Justice Surya Kant waved away the federal agency’s argument against releasing the AAP leader, saying, “Don’t say that.”

Appearing for the CBI, Additional Solicitor General SV Raju also argued that Mr Kejriwal had incorrectly bypassed the lower court – i.e., Delhi’s Rouse Avenue Court – and approached the High Court for bail.

“He approached High Court without going to Sessions Court… on merits, trial court could have seen it first. High Court can only see in exceptional cases…” he said, declaring releasing Mr Kejriwal now would demotivate the High Court.

The CBI’s logic also drew a sarcastic swipe from AAP MP Raghav Chadha, who posted on X, “If the Sun rises from the East, it will demoralise the West.”

In early August the High Court rejected Mr Kejriwal’s bail plea, directing him to approach the sessions court for relief. The AAP, however, opted to move the country’s top court, citing its observation in the release of ex Deputy Chief Minister Manish Sisodia, that “sending the appellant back to the trial court would be like playing a game of snakes and ladders…”

After Thursday’s hearing the top court reserved its verdict on Mr Kejriwal’s bail plea. The court also reserved its verdict on a separate plea challenging the CBI’s arrest of the Chief Minister.

The AAP chief was arrested by the CBI in June; he was taken into custody at the Rouse Avenue Court shortly after securing bail for his arrest by the Enforcement Directorate in the same case.

Senior advocate Abhishek Singhvi, appearing for Mr Kejriwal, criticised the CBI’s arrest as an “insurance” to keep the AAP leader in jail for as long as possible, particularly with the Delhi Assembly election due early next year. Mr Singhvi pointed out Arvind Kejriwal had received bail in the ED case, which meant he had fully satisfied the ‘triple test’ legal principle for release.

It was also pointed out that all others accused in the alleged liquor policy scam – Mr Sisodia and AAP Rajya Sabha MP Sanjay Singh, as well as Bharat Rashtra Samithi leader K Kavitha – had bail.

“Prolonged incarceration cannot be there…” Mr Singhvi said, referring to statements by the top court in releasing Mr Sisodia, “Is ‘triple test’ satisfied? Yes… in the Manish Sisodia judgment, the court held that in this particular case of excise policy, trial is impossible to finish.”

Mr Kejriwal has been in jail since late-March. He received temporary reprieve in June, before Delhi voted in the general election, but had to return to Tihar Jail after the results were out.

The ED and CBI contend Arvind Kejriwal played a key role in forming of a new liquor excise policy for Delhi, which allowed him to sell wholesale licences and get kickbacks, around Rs 100 crore of which, the authorities claim, came from a ‘South group’ led by the BRS’ K Kavitha.

This money, the agencies allege, was used to fund the AAP’s election expenses in Goa.

Mr Kejriwal, the AAP, and other accused have denied the charge, counter-accusing rivals Bharatiya Janata Party, to whose government at the centre the agencies answer, of mounting a campaign against opposition politicians and parties, particularly before elections.

The Supreme Court on Monday refused Delhi Chief Minister Arvind Kejriwal immediate relief in his battle to overturn the High Court’s interim stay on a bail order issued last week by a lower court.

The court responded to Mr Kejriwal’s arguments – the High Court erred in staying bail without first perusing the order, and rationale, of the lower court – by saying it would wait till the said order came on record, and the High Court had a chance to re-examine the stay – before acting on the matter.

The court has fixed Wednesday as the next hearing date; the High Court is expected to deliver its full verdict on Tuesday. “It is not proper to interfere when the High Court has reserved its judgement,” the Supreme Court said, “We will keep this petition for hearing for day after tomorrow.”

This was after Additional Solicitor General Tushar Mehta, appearing for the Enforcement Directorate – which arrested Mr Kejriwal in the liquor policy case March and has opposed bail and medical relief claimed by the Chief Minister – said the High Court is likely to render its verdict within 24 hours.

Earlier, as the day’s (brief) hearing began, Mr Kejriwal’s lawyers argued that the “balance of convenience” is in the Chief Minister’s favour, reasoning there is no substantial reason for the AAP leader to stay in jail. “If bail is reversed, he will certainly go back to jail… as he did after the Supreme Court’s interim release (to campaign for the election),” senior advocate Abhishek Singhvi said.

He was referring to Mr Kejriwal’s release last month – allowed by the top court – to campaign for his party and the Congress-led INDIA bloc in the 2024 Lok Sabha election, in which Prime Minister Narendra Modi’s BJP was pegged back and forced to rely on its allies to form the government.

Mr Singhvi also referred to the top court’s order granting Mr Kejriwal that interim bail, in which it acknowledged the Delhi Chief Minister is not a “habitual offender” or a “flight risk”.

“Why can’t I be free in the interim? I have a judgment in my favour…” he continued, responding to the court suggesting the Chief Minister be patient for 24-48 hours till the High Court reads its order.

“If we pass order now, we will prejudge the issue. This is not a subordinate court…” he was told.

Hours before he was set to be released from Tihar Jail, Delhi Chief Minister Arvind Kejriwal suffered a major setback when the Delhi High Court paused his bail order in a corruption case related to the Delhi Liquor Policy. The move came after  Enforcement Directorate challenged Mr Kejriwal’s bail in a new petition.

The ED mentioned its petition challenging the trial court’s bail order for an urgent hearing before a bench of Justices Sudhir Kumar Jain and Ravinder Dudeja. The high court said till it heard the petition, the trial court order would not be acted upon. 

The AAP chief had secured bail on a personal bond of Rs 1 lakh albeit with conditions on Thursday, in a relief after he was arrested on March 21. Earlier, the Supreme Court had issued interim bail to Mr Kejriwal to campaign for Lok Sabha elections and he returned to jail on June 2.

Arvind Kejriwal granted bail in Delhi Excise policy case

A Delhi court granted bail to Delhi Chief Minister Arvind Kejriwal, who was arrested by the Enforcement Directorate in a money laundering case linked to the now-scrapped Delhi Excise policy of 2021-22. Delhi Chief Minister Arvind Kejriwal has been granted bail in the liquor policy case.

New Delhi:

Delhi Chief Minister Arvind Kejriwal has been granted bail in the liquor policy case. Mr Kejriwal’s lawyer had argued the Enforcement Directorate (ED) had no evidence against him.

The Aam Aadmi Party (AAP) chief is likely to come out of jail tomorrow, as the bail order has to reach the jail first.

His lawyer told the Delhi court that the ED’s entire case against the Aam Aadmi Party (AAP) chief rested on statements given by those who turned approver in the case.

The court denied the ED’s request to allow at least 48 hours to sign the bail bond in order for the central agency to challenge it before the relevant court.

“The statements are of those people who have confessed to being guilty. They are not saints here. They are those who are not only tainted, but it appears that some who were arrested were given a promise of bail, and promise of being granted pardon. Approvers. And there is another category who have not been arrested,” Mr Kejriwal’s lawyer had said earlier today, after which the court had reserved its order, only to announce the bail around 8 pm.

“Circumstances have to be so intrinsically linked (as to) lead to the guilt. These statements by tainted persons discredit the case of prosecution. There is no evidence that Rs 100 crore came from ‘South Group’. These are all statements. There is no evidence,” the Chief Minister’s lawyer said, referring to what the ED calls the ‘South Group’, a lobby from Telangana that allegedly conspired to grab liquor licences in the national capital.

The ED arrested Mr Kejriwal on March 21 over money laundering allegations while framing the Delhi liquor policy for 2021-22, which was later scrapped after the Lieutenant Governor raised red flags. The ED has alleged the money Mr Kejriwal got from the liquor sellers was used to fund the party’s campaign in Goa, since he is the convenor of the AAP.

Mr Kejriwal and the AAP have from the start maintained the Centre has been misusing its agencies to harass the Opposition with false cases.

Arvind Kejriwal has filed a regular bail plea before a court in New Delhi.

New Delhi:

Delhi Chief Minister Arvind Kejriwal has filed a regular bail plea before a court in New Delhi, which is slated to hear it at 2 pm today, in connection with a money laundering case related to the alleged excise policy scam.

Mr Kejriwal was ordered to be released on interim bail till June 1 by the Supreme Court in view of the ongoing general elections.

On Wednesday, the Supreme Court registry had refused to accept the application moved by him seeking a seven-day extension of interim bail to undergo medical examinations, including a PET-CT scan.

The Supreme Court registry said that the top court had already reserved its verdict in the matter and the application seeking a 7-day extension has no relation to the main petition.

As Supreme Court had allowed him to move the trial court for obtaining regular bail, the application is not maintainable, it added.

As per the Aam Aadmi Party, Chief Minister Kejriwal’s health has deteriorated since he was arrested in the alleged Delhi excise scam.

The party has said that he has lost 7 kg in weight after his arrest and his Ketone levels are also very high indicating a serious medical disorder.

The party has further said that the Chief Minister was required to do medical tests and seven days were needed for this.

Earlier, the top court had directed him to surrender back to Tihar Jail on June 2.

The top court on May 17 had reserved its verdict on Chief Minister Kejriwal’s petition challenging his arrest and subsequent remand by the federal anti-money laundering agency in the excise policy case.

It said he could approach the trial court for a grant of regular bail notwithstanding the fact that the top court reserved judgment in the matter.

Delhi Chief Minister Arvind Kejriwal has petitioned the Supreme Court for a seven-day extension on his interim bail in connection with the Delhi liquor policy case. Citing serious health concerns, Mr Kejriwal highlighted the need for medical tests, including a PET-CT scan, following a weight loss of 7 kg and elevated ketone levels.

Mr Kejriwal was initially granted interim bail until June 1 by the Supreme Court to facilitate his participation in the Lok Sabha election campaign. As per the ruling, he is required to surrender and return to Tihar Jail on June 2.

Max Hospital’s medical team has already conducted preliminary examinations. The Chief Minister’s legal counsel argued that these tests are crucial for his well-being and requested the court to consider the extension to complete the necessary medical investigations.

The interim bail granted to Mr Kejriwal has sparked controversy, with BJP leaders alleging that he received “special treatment” from the Supreme Court. However, the justices involved in granting the bail have firmly stated that no exceptions were made in Mr Kejriwal’s favour.

The ongoing probe revolves around alleged irregularities in the formulation and implementation of the Delhi excise policy (2021-22). 

The excise policy, introduced to bring an overhaul to the national capital’s liquor business, promised a more modern shopping experience with discounts and offers. However, Delhi Lieutenant Governor Vinai Kumar Saxena’s order to investigate alleged irregularities prompted the policy’s cancellation. The AAP accuses Mr Saxena’s predecessor, Anil Baijal, of making last-minute changes that adversely affected the policy’s revenue expectations.

AAP leader and former deputy chief minister of Delhi Manish Sisodia is already under judicial custody in connection with the case. Mr Sisodia, the former Delhi Deputy Chief Minister, was arrested by the Central Bureau of Investigation (CBI) on February 26 last year, while party leader Sanjay Singh, a Rajya Sabha member, was arrested by the ED on October 5 and was granted bail in April this year.

The BJP has been attacking Arvind Kejriwal for not stepping down despite being in custody

New Delhi:

Delhi Chief Minister Arvind Kejriwal on Saturday addressed his first press conference and held roadshows for the Lok Sabha election campaign, a day after the Supreme Court granted him interim bail for 21 days.

Mr Kejriwal, the national convenor of the Aam Aadmi Party (AAP), was arrested by the Enforcement Directorate (ED) in a money-laundering case linked to the now-scrapped Delhi liquor policy case.

Addressing a press conference at the AAP’s office in the national capital, he revealed why he didn’t resign, a Bharatiya Janata Party’s continuous demand since he was arrested on March 21.

“The chief minister’s post is not important for me. I did not step down as the chief minister because a conspiracy was hatched to force me to resign on a fake case,” Mr Kejriwal said.

The BJP had been attacking the Delhi Chief Minister for not stepping down from the chief minister’s post despite being in custody for 50 days.

“If the prime minister wants to learn about fighting corruption, he should learn from Arvind Kejriwal. We sent the corrupt to jail and even our own ministers,” the AAP chief said.

“AAP Not Just A Party, It Is A Thought”

Arvind Kejriwal alleged that Prime Minister Narendra Modi has “left no stone unturned to crush the AAP by sending its four top leaders to prison”.

He was the fourth senior AAP leader to spend time behind bars after Satyendar Jain, Manish Sisodia, and Sanjay Singh.

“They thought that the party would be finished. But AAP is not just a party, it is a thought, the more they destroy, the more our party will progress,” Mr Kejriwal asserted.

He told the AAP supporters that no one had expected that he would be able to come out in the middle of the Lok Sabha elections. “But because of your prayers and blessings of Lord Hanuman I am among you all,” he added.

“Kejriwal has fought against corruption. We have not spared even our ministers in corruption cases. They were sent to jail without the opposition and the media knowing about it,” he said.

“Missed People Of Delhi A Lot”

Arvind Kejriwal held his first roadshow for the Lok Sabha election campaign in the South Delhi constituency and said that he “missed the people of Delhi a lot”.

“I have come straight to you after being released from jail. I missed people of Delhi a lot. I want to thank crores of people who prayed and sent blessings to me,” he said.

Mr Kejriwal recalled his 50 days in Tihar jail and said that his wife, Sunita Kejriwal, Punjab Chief Minister Bhagwant Mann, and his ministers used to come to meet him.

“I used to ask my ministers about the welfare of people while in jail. During my stay in jail, I used to think what was my fault that I was arrested. My fault was that I provided good schools and hospitals for people. I provided health facilities to people. They (BJP) stopped my insulin for 15 days in jail,” he said.

“They want to shut everything to paralyse the Delhi government,” he charged.  

The Supreme Court has granted Arvind Kejriwal interim bail to enable him to campaign in the ongoing Lok Sabha elections. He, however, has to surrender on June 2, a day after the last phase of the seven-phase poll will get over.

“I missed Delhi people a lot,” said Arvind Kejriwal

AAP convenor and Delhi Chief Minister Arvind Kejriwal on Saturday asserted that the BJP will not form the government on June 4 and said if the INDIA bloc comes to power, the direction and fate of the country will change. He held his first roadshow for Lok Sabha election campaign along with his Punjab counterpart Bhagwant Mann in the South Delhi constituency, a day after his release from Tihar jail.  “It is a historic moment. The history is taking a turn. If the INDIA bloc forms government, the direction and fate of the country will change.

“I am fighting against dictatorship with all my power. I need your support. The country never accepted any dictator and people removed them. I have come to seek your support to fight dictatorship,” he said. He also asserted that the Modi government will not be formed on June 4.

“They are losing seats everywhere, be it Karnataka, Haryana. In Punjab, they will not win anything and even in Delhi, all the seven seats will be won by the INDIA bloc,” he claimed.  If the INDIA bloc comes to power, full statehood will be provided to Delhi, he said.      Party leaders and workers gathered in large numbers while Arvind Kejriwal and Bhagwant Mann mounted an open-roof vehicle waving and greeting people.

Remembering his former ministers Manish Sisodia and Satyendar Jain, who are in Tihar jail, he claimed they changed the face of schools and hospitals. “Sisodia changed the face of schools in Delhi. He should be made the Union minister of education,” he said.

AAP volunteers, holding party flags and raising slogans, marched behind the vehicle in the narrow streets of Mehrauli in South Delhi, in support of party candidate Sahi Ram Pehalwan.

Arvind Kejriwal, who is out on an interim bail granted by the Supreme Court till June 1, earlier in the day said he will campaign across the country to fight against “dictatorship”. He will also take part in a roadshow in East Delhi constituency in support of AAP candidate Kuldeep Kumar.

Arvind Kejriwal Bail Plea Live: a Delhi court extended his judicial custody till May 20

The Supreme Court is expected to give its verdict today on interim bail to Delhi Chief Minister Arvind Kejriwal, who was arrested in a money laundering case and is seeking a release from jail to campaign for the ongoing Lok Sabha polls.

A bench, comprising Justices Sanjiv Khanna and Dipankar Datta, had reserved its verdict on Mr Kejriwal’s interim bail on May 7.

Mr Kejriwal, the national convenor of the Aam Aadmi Party (AAP), was arrested on March 21 by the Enforcement Directorate (ED) in a money laundering case linked to the alleged liquor policy scam. He is currently lodged in Tihar jail under judicial custody.

Earlier Tuesday, a Delhi court extended his judicial custody till May 20.

Arvind Kejriwal Live: What ED Said On Arvind Kejriwal’s Bail

The ED, in its affidavit in Supreme Court, repeated an argument it had made during the last Supreme Court hearing and said that campaigning is part of a politician’s job and, following the rule of equality, small farmers or small traders can also seek interim bail to carry out the demands of their work. 

It also stressed that Arvind Kejriwal is not even contesting the ongoing Lok Sabha elections.

The central agency said that granting bail to the AAP chief would set a precedent that would permit “all unscrupulous politicians” to commit crimes and then evade investigation citing campaigning for one election or the other.

Arvind Kejriwal’s Interim Bail Live: Probe Agency’s Affidavit In Supreme Court

In its affidavit filed in the Supreme Court on Thursday, the ED pointed out that, while hearing the bail plea of former Delhi deputy chief minister Manish Sisodia — a co-accused in the same Delhi liquor policy case — the court had said that the laws apply equally to all citizens and institutions, including the State.

Stating that Arvind Kejriwal had sought interim bail primarily for campaigning in the Lok Sabha elections, the agency submitted, “It is relevant to note that the right to campaign is neither a fundamental right nor a constitutional right and not even a legal right.”

The agency also argued that 123 elections have taken place in the past five years and if interim bail is granted to Mr Kejriwal for campaigning, then no politician can be kept in judicial custody since polls take place around the year.

Arvind Kejriwal’s Bail Live: Probe Agency ED Opposes Arvind Kejriwal’s Bail

The probe agency ED has filed an affidavit in the Supreme Court opposing Arvind Kejriwal’s petition. It said that laws are equal for all and that campaigning for the Lok Sabha polls is not a fundamental, constitutional, or even a legal right.

The central agency also said that no political leader has ever been granted bail for campaigning and that letting Mr Kejriwal, the national convenor of the Aam Aadmi Party (AAP), out of jail to canvas for his party candidates would set a wrong precedent.

Arvind Kejriwal Bail Live: Supreme Court Had Reserved Its Verdict On May 7

A Supreme Court bench, comprising Justices Sanjiv Khanna and Dipankar Datta, had reserved its verdict on interim bail of Arvind Kejriwal on May 7.

The bench reserved its decision after hearing the arguments put forth by senior advocate Abhishek Singhvi, who appeared for Mr Kejriwal, and Additional Solicitor General SV Raju, who appeared for the Enforcement Directorate.

The bench has divided the hearing on Mr Kejriwal’s petition against his arrest into two parts. His main petition challenges his arrest by the probe agency and seeks it to be declared as “illegal”. The second aspect pertains to the grant of interim bail keeping in mind the ongoing Lok Sabha polls.
