New Delhi:

Trinamool Congress MP Mahua Moitra on Friday said that she will not appear before the Lok Sabha Ethics Committee, which is probing the “cash-for query” allegations on October 31 because she has prior commitments. She added, however, that she was “looking forward” to deposing before the committee any time after November 5 and said it was “imperative” and in the interest “of natural justice” that she be allowed to cross-examine businessman Darshan Hiranandani, who has levelled a series of allegations against her. 

In an affidavit, Mr Hiranandani had claimed that Ms Moitra had given him her parliament login ID to frame questions on the Adani Group, which she felt was the “only way” to target Prime Minister Narendra Modi. He also claimed that she had made demands for “various favours” and he had gifted her expensive luxury items. 

In a letter to BJP MP Vinod Sonkar, who is the chairman of the Ethics Committee, that she posted on X, formerly Twitter, Ms Moitra said she was eagerly looking forward to physically attending and presenting her defence against the “slanderous charges” levelled against her at the next date provided by the committee. 

In its hearing on Thursday, the committee had recorded the statements of BJP MP Nishikant Dubey, who had filed a complaint against Ms Moitra before the Lok Sabha Speaker, and Supreme Court lawyer Jai Anant Dehadrai, on whose letter the complaint was based. 

Ms Moitra pointed out that few details were available on the gifts Mr Hiranandani had allegedly given her and said she should be allowed to cross-examine him. 

“His affidavit, available in the public domain, is extremely scant on detail and provides no actual inventory of what he has allegedly given me. Given the seriousness of the allegations and in keeping with the principles of natural justice, it is imperative that I am allowed to exercise my right to cross-examine Shri Hiranandani,” she said.

Stressing on the need for the committee to depose Mr Hiranandani, the Trinamool MP said that not doing so would be like holding a “kangaroo court”. 

“It is also imperative that he appear before the committee and provide a detailed verified list of the alleged gifts & favours he allegedly provided to me. I wish to place on record that any enquiry without the oral evidence of Shri Hiranandani will be incomplete, unfair and akin to holding a proverbial ‘kangaroo court’ and that he too will need to be called to depose before the Committee before it prepares its final report,” she wrote.

‘Announced On TV’

In her post with the letter, Ms Moitra claimed that Mr Sonkar had announced her October 31 summons on live TV long before the official letter was mailed to her. 

“Chairman, Ethics Comm announced my 31/10 summons on live TV way before official letter emailed to me at 19:20 hrs. All complaints & suo moto affidavits also released to media.  I look forward to deposing immediately after my pre-scheduled constituency programmes end on Nov 4,” she wrote.

Explaining the reasons for not appearing on October 31, Ms Moitra said Durga Puja is the biggest festival in West Bengal and she had already “committed to attending numerous pre-scheduled Vijaya Dashami Sammelans/meetings (both government and political) in my constituency (Krishnanagar) from 30th October to 4th November 2023 and cannot be in Delhi on 31st October 2023”.

She also pointed out that a similar courtesy had been extended to BJP MP Ramesh Biduri who had been summoned by the Privileges Committee on October 10 and had requested more time since he had scheduled political meetings in Rajasthan.

After the first hearing on Thursday, sources had told NDTV that the panel had agreed that the allegations against Ms Moitra were “very serious”.

Mahua Moitra has been summoned by the parliament ethics committee

New Delhi:

Trinamool Congress MP Mahua Moitra has been summoned by the Lok Sabha ethics committee on October 31 in the “cash for query” controversy. The committee agreed the allegations against Ms Moitra were “very serious”.

In a nearly three-hour-long proceeding today, the committee heard both BJP MP Nishikant Dubey and lawyer Jai Anant Dehadrai and discussed every aspect of the allegations they have made against the Trinamool Congress MP, sources said.

The ethics committee chairman Vinod Sonkar told reporters they have sent letters to the Information Technology Ministry and the Home Ministry seeking details on key aspects of the case for a deeper investigation.

“We heard the lawyer and Nishikant Dubey ji. Taking note of the seriousness of the allegations, we have decided to summon Mahua Moitra on Tuesday. She should come and present her side of the matter,” Mr Sonkar told reporters after the ethics committee proceeding ended.

Mr Dehadrai, on whose complaint to the Central Bureau of Investigation (CBI) the entire case rests, was cross-examined by the ethics committee, while Mr Dubey was allowed to explain his allegations, sources said.

Referring to the CBI complaint, Mr Dubey had written to Lok Sabha Speaker Om Birla and levelled cash-for-query allegations against Ms Moitra. The Trinamool MP has called the Supreme Court lawyer her “jilted ex”.

The letter claimed to share “irrefutable evidence” of businessman Darshan Hiranandani giving bribes to Ms Moitra to ask questions in parliament. The questions were allegedly designed to target the Adani Group.

The ethics committee will give a report to the Lok Sabha Speaker “as early as possible”, people with direct knowledge of the matter told NDTV, referring to the Pawan Bansal committee that gave its report in just two weeks in December 2005 in the infamous cash-for-questions scam when the United Progressive Alliance (UPA) was in power in the centre.

Mr Dehadrai told reporters the proceedings were “cordial and pleasant” and he answered all the questions the ethics committee asked. “Everything was very cordial and they were very pleasant. Some questions were put to me and I have answered those questions,” he said while leaving.

Mr Dubey said he will be available whenever the ethics committee calls him. “They were normal questions… All I can say is the MPs are concerned. When they call me next I will come. The question is whether the propriety and dignity of parliament will hold. It is a question of the dignity of parliament. The ethics committee is more worried than me,” Mr Dubey told reporters.

In an affidavit, Mr Hiranandani alleged the Trinamool MP shared her MP email so that he could send her information and she could raise the questions in parliament. He alleged she later gave him her parliament login and password for him to post the questions directly. The ethics committee reaching out to the Information Technology Ministry and the Home Ministry is linked to the alleged misuse of the parliament login ID and password by Ms Moitra.

Ms Moitra has denied the allegations and said she is prepared for any inquiry. She has also said that she is ready to answer questions from the Lok Sabha ethics committee.

Neither The Trinamool nor its INDIA bloc allies have come out in support of Ms Moitra so far. The Trinamool has said it will not comment on the case. The party’s leader in the Rajya Sabha, Derek O’Brien, has said they will take an appropriate decision on the allegations against Ms Moitra after the parliamentary panel completes its investigation.

Trinamool Congress MP Mahua Moitra, in a two-page statement and five questions, shredded the affidavit of businessman Darshan Hiranandani, alleging that the Prime Minister’s Office “held a proverbial gun” to his head and made him sign the white paper that was later “leaked to the press”.

“Darshan Hiranandani has not been summoned by the CBI or the Ethics Committee or indeed by any investigative agency yet. Who then has he given this affidavit to,” she said in the statement posted on X, formerly Twitter.  

Questioning if it was indeed an affidavit from the businessman, Ms Moitra pointed out that it was neither on a official letterhead or notarized. It was not posted on social media by him but was “leaked selectively to the media,” she said in the statement posted on X, formerly Twitter.  

Calling it a “selective leak of a plea bargain”, Ms Moitra said this is part of the establishment’s witch hunt into every political leader who dares question Adani”.

Mr Hiranandani’s affidavit claimed Ms Moitra had asked for help to politically target Prime Minister Narendra Modi and use the Adani group for a smear campaign against him. He claimed she has also given him her parliament login ID to frame questions on the Adani Group.

Mahua Moitra thought the “only way” to attack PM Modi was by attacking Gautam Adani, and so she “expected support”, the affidavit read. For this, she shared her parliament login ID so he could frame the questions, Mr Hiranandani said. He went along with the idea because he thought through her, he would get support in the Opposition-ruled states, he wrote.

He also claimed the Trinamool MP received support from others in this effort, including journalists, Opposition leaders and former Adani Group employees, who fed her unverified information. In this context, he had named several people including journalist Sucheta Dalal, who has denied the allegations.

Last week, the BJP’s Nishikant Dubey, in a letter to Lok Sabha Speaker Om Birla, demanded immediate suspension of Ms Moitra, alleging that she “took bribes to ask questions” in parliament from Darshan Hiranandani to target his business rival, the Adani group, and PM Modi.

Accusing Ms Moitra of breach of parliamentary privilege, contempt of House and criminal conspiracy, he sought her immediate suspension from parliament.

The Hiranandani Group had lost energy and infra contract to the Adani Group and Ms Moitra’s questions were directed at perpetuating the business interests of the former, Mr Dubey alleged in his letter to Mr Birla.

His complaint has been referred by the Speaker to Parliament’s Ethics Committee.

Ms Moitra had denied the allegations, saying she welcomes any kind of inquiry.

Businessman Darshan Hiranandani’s explosive affidavit on his links with Trinamool Congress MP Mahua Moitra and claims on her efforts to target Prime Minister Narendra Modi by using the Adani Group, has brought cheer to her detractors. Most of them hailed the affidavit as a victory for truth. Others named as Mahua Moitra’s allies, like journalist Sucheta Dalal, called the affidavit a “farce”.

In his affidavit, Darshan Hiranandani claimed Mahua Moitra had given him her parliament login ID to frame questions on the Adani group, which she felt was the “only way” to target Prime Minister Narendra Modi.

He also claimed that Ms Moitra received support from others in this effort, including journalists, Opposition leaders and former Adani Group employees, who fed her unverified information. In this context, he named Sucheta Dalal and a few others.

The BJP’s Nishikant Dubey, who had sought Mahua Moitra’s suspension from parliament in a letter to Lok Sabha Speaker Om Birla, in a Hindi post on X, formerly Twitter, said, “The security of the country and the dignity of the Parliament are paramount for me. Satyamev Jayate”.

“Truth always wins” was the one-liner from Jai Anant Dehadrai, who had initially contacted the Central Bureau of Investigation with allegations against the Trinamool MP.

Sucheta Dalal, on the other hand, called it “stupefying” and claimed she does not know Mahua Moitra “personally at all”.

“This is completely stupefying — I do not know @MahuaMoitra personally at all – I may have retweeted some of her stuff. I don’t know Pallavi Shroff and I used to know #ShardulShroff long ago. I dare anyone to find any links between me and them. Requesting IT minister @Rajeev_GoI to help me get to the bottom of it @AshwiniVaishnaw also please help. This is one time the govt ought to help prevent this kind of slander by some crooks!!” read her post on X.

“I don’t know @MahuaMoitra – and I think she can confirm it. The question of helping her simply does not arise, NOR did she EVER reach out and ask for any help either !” read another of her posts.

Trinamool’s Majid Memon, who is also a noted advocate of the Supreme Court, pointed out that such issues should be brought to the notice of the Parliamentary Ethics Committee and not be leaked to the media. “Mr Darshan Hiranandani must remember that if he is trying to suggest that he has bribed the MP to do something that she is not supposed to do then the bribe giver is equally liable for criminal action,” he said.

He, however, made it clear that he was speaking as a lawyer and not a representative of the party.

In his affidavit, Mr Hirandani has claimed that Ms Moitra, “in her endeavour, was getting help from other people like Sucheta Dalal, Shardul Shroff, and Pallavi Shroff, who were also in touch with her, and who were feeding her with all kinds of unverified information relating to Gautam Adani and his companies”.

“She also received unverified details from several sources, including some claiming to be former Adani group employees. Certain information was shared with me, based on which I continued to draft and post questions using her parliamentary login whenever needed,” read the affidavit, accessed by NDTV.

In his letter to Om Birla, Nishikant Dubey had alleged that the Hiranandani Group had lost energy and infra contract to the Adani Group and Ms Moitra’s questions were directed at perpetuating the business interests of the former.

Mr Hiranandani has claimed that he was helping Ms Moitra in her efforts to target PM Modi through the Adani Group. While admitting that he had also granted favours to Ms Moitra, he claimed these were given on her demand.

“She made frequent demands of me and kept asking me for various favours which I had to fulfil in order to remain in close proximity of her and get her support… I could ill afford to displease her. Many a time I felt she was taking undue advantage of me and pressurising me to do things I didn’t want to but I had no choice, because of the aforementioned reasons,” his affidavit read.

The favours included gifting her expensive luxury items, “providing support for renovation of her officially allotted bungalow in Delhi, travel expenses, holidays etc,” he wrote.

Mahua Moitra shredded Mr Hiranandani’s affidavit. “Darshan Hiranandani has not been summoned by the CBI or the Ethics Committee or indeed by any investigative agency yet. Who then has he given this affidavit to,” she said in the statement posted on X, formerly Twitter.

Trinamool MP Mahua Moitra, at the centre of “cash-for-questions” controversy, took on Gautam Adani to embarrass Prime Minister Narendra Modi and was assisted by others, including Congress leader Rahul Gandhi, in this “targeted attack”, claims businessman Darshan Hiranandani.

Mr Hiranandani, in a signed affidavit, admitted using Ms Moitra’s Parliamentary login to ask questions targeting the Adani Group.

On Sunday, BJP MP Nishikant Dubey and Ms Moitra’s former partner and lawyer Jai Anant Dehadrai alleged that the Trinamool leader took favours from Darshan Hiranandani to raise questions in parliament. The leader has filed a defamation suit before the Delhi High Court against them.

“Ms Mahua Moitra was very ambitious and wanted to quickly make a name for herself at the national level. She was advised by her friends and advisors that the shortest possible route to fame is by personally attacking Narendra Modi,” said Darshan Hirandani, the CEO of real estate-to-energy group Hiranandani.

The complaint by the BJP MP has been referred by the Lok Sabha Speaker Om Birla to Parliament’s Ethics Committee.

Ms Moitra has denied the allegations and said she is prepared for any inquiry.

“Clearly, there were others who were also assisting her in this targeted attack. She had interactions with many Congress leaders, including Rahul Gandhi, on matters relating to Adani companies,” said Mr Hiranandani, adding that he found the Trinamool leader “knowledgeable, expressive and outspoken”.

Detailing their first encounter, the businessman said they met in 2017 at the Bengal Global Business Summit 2017. At the time, Ms Moitra was an MLA and designated to engage with visiting industrialists at the summit.

Mr Hiranandani admitted using Ms Moitra’s Parliamentary login to ask questions targeting the Adani Group.

“We have always been in the business of business and not in the business of politics. Our group has always worked with the government in the interest of the nation and will continue doing so,” a Hiranandani spokesperson said when the controversy first broke.

The Hiranandani Group lost energy and infra contracts to Adani Group and Ms Moitra’s questions were directed at perpetuating the Hiranandani Group’s interests, Mr Dubey indicated in the letter to the Speaker.

The Adani Group has said the allegations against Ms Moitra prove that some groups and individuals have been “working overtime” to harm its “name, goodwill and market standing”.

In a big twist in the alleged ‘cash for query’ scam, businessman Darshan Hiranandani has claimed that he used Trinamool Congress MP Mahua Moitra’s Parliament login ID to ask questions targeting Prime Minister Narendra Modi and the Adani Group.

Mr Hiranandani – in a signed affidavit – claimed that Ms Moitra “made frequent demands” including “expensive luxury items and logistical help for her holidays.” His affidavit also claimed that she had interactions with many Congress leaders, “including Rahul Gandhi, on matters relating to Adani companies”.

Here are 10 stunning revelations made by Darshan Hiranandani on Mahua Moitra:

  1. Mahua Moitra wanted to quickly make a name for herself at the national level. She was advised by her friends and advisors that the shortest possible route to fame is by personally attacking PM Modi.
  2. Ms Moitra thought that the only way to attack PM Modi is by attacking Gautam Adani as both were contemporaries, and they belong to the same state of Gujarat.
  3. She drafted a few questions that would have elements to embarrass the government by targeting the Adani group.
  4. She shared with me her email ID as a Member of Parliament, so that I could send her information, and she could raise the questions in the Parliament. She later provided me her Parliament login and password so that I could post the questions directly.

Trinamool Congress MP Mahua Moitra frequently interacted with journalists from Financial Times, the New York Times, the BBC, and several national publications, businessman Darshan Hiranandani claimed in an explosive affidavit today. The businessman found himself in the centre of a political whirlpool after BJP MP Nishikant Dubey accused Ms Moitra of taking cash and favours from the Hiranandani Group to question the Adani group and target Prime Minister Narendra Modi.

“She (Mahua Moitra) also had frequent interactions with international journalists from the Financial Times, the New York Times, the BBC, and also with several Indian publications,” the affidavit claimed.

The firebrand MP was “fed unverified information about Gautam Adani and his companies” by several lawyers and Indian journalists, it alleged.

“Ms Moitra, in her endeavour, was getting help from other people like Sucheta Dalal, Shardul Shroff, and Pallavi Shroff, who were also in touch with her, and who were feeding her with all kinds of unverified information relating to Gautam Adani and his companies,” the affidavit, accessed by NDTV, read.

“She also received unverified details from several sources, including some claiming to be former Adani group employees. Certain information was shared with me, based on which I continued to draft and post questions using her parliamentary login whenever needed,” Mr Hiranandani said.

Journalist Suchet Dalal, however, denied being personally acquainted with Ms Moitra and sought the government’s help to “prevent this kind of slander by some crooks”.

“This is completely stupefying — I do not know Mahua Moitra personally at all – I may have retweeted some of her stuff. I don’t know Pallavi Shroff and I used to know Shardul Shroff long ago. Last week, BJP MP Nishikant Dubey, citing a letter he received from advocate Jai Anand Dehadrai, accused Ms Moitra of accepting money and favours from businessman Darshan Hiranandani to ask questions in Parliament to target PM Modi and the Adani Group. The MP went to Lok Sabha Speaker Om Birla with his complaint and demanded Ms Moitra’s immediate suspension.

Following this, the Speaker referred the matter to the Lok Sabha ethics committee, which asked the BJP MP and advocate Jai Anand Dehadrai for a hearing on October 26.

The Trinamool Congress MP has denied all allegations and said she is prepared to face a probe.

Businessman Darshan Hiranandani, in an explosive affidavit today, claimed Trinamool Congress MP Mahua Moitra had given him her parliament login ID to frame questions on the Adani group, which she felt was the “only way” to target Prime Minister Narendra Modi. In the three-page affidavit, a copy of which is with NDTV, Mr Hiranandani confessed to a few points that are among the BJP allegations against Ms Moitra. But it does not mention the main charge against her — that she asked over 50 parliamentary questions on behalf of the Hiranandani Group to get the better of its business rival, the Adani Group.

The affidavit indicates the case was rather the opposite — that she asked for help to politically target PM Modi and use the Adani group for a smear campaign against him.

Ms Moitra, in a two-page statement and five questions, shredded the affidavit of Mr Hiranandani, alleging that the Prime Minister’s Office “held a proverbial gun” to his head and made him sign the white paper that was later “leaked to the press.

Mr Hiranandani’s claim is still a setback for Ms Moitra, whom the BJP wants suspended from parliament. The allegation that she handed Mr Hiranandani her parliament login ID, if proved, could comprise a breach of privilege that could bring a suspension order against her.

Caught in the “cash-for-questions” controversy swirling around Ms Moitra, Mr Hiranandani said he was filing the affidavit since the matter involves him and has snowballed into a political controversy roping in the Parliamentary Privilege Committee and the judiciary.

Mahua Moitra thought the only way to attack PM Modi was by attacking Gautam Adani, and so she “expected support”, the affidavit read. For this, she shared her parliament login ID so he could frame the questions, Mr Hiranandani said. He went along with the idea because he thought through her, he would get support in the Opposition-ruled states.

He also claimed that Ms Moitra received support from others in this effort, including journalists, Opposition leaders and former Adani Group employees, who fed her unverified information. In this context, he named Sucheta Dalal — who has denied the allegations in a post on X — and a few others.

Mr Hiranandani also claimed the Trinamool MP was also was a “dominating” and “ambitious” person who also made a number of demands for “various favours” which he met to retain her support and their close friendship. The list included gifting her expensive luxury items, “providing support for renovation of her officially allotted bungalow in Delhi, travel expenses, holidays etc,” he wrote.

“I could ill afford to displease her,” the affidavit read. “Many a time I felt she was taking undue advantage of me and pressurising me to do things I didn’t want to, but I had no choice, because of aforementioned reasons,” he added.

Last week, the BJP’s Nishikant Dubey demanded immediate suspension of Ms Moitra, alleging that she “took bribes to ask questions” in parliament from Darshan Hiranandani to target his business rival, the Adani group, and PM Modi. Mr Dubey wrote to Lok Sabha Speaker Om Birla, accusing Ms Moitra of breach of parliamentary privilege, contempt of House and criminal conspiracy.

The Hiranandani Group had lost energy and infra contract to the Adani Group and Ms Moitra’s questions were directed at perpetuating the business interests of the former, Mr Dubey alleged in his letter to Mr Birla.

His complaint has been referred by the Speaker to parliament’s Ethics Committee.

The next day, junior Union minister for Information Technology Rajeev Chandrasekhar weighed in on the controversy and indicating Mr Hiranandani’s involvement.

“It is true that this company was actively and aggressively lobbying for Data Localization. Language used in PQ is very similar (linking need for data localization to data breaches) to that used whn the head of this company met me. I am not aware or privy to the full facts or background on this – but if it is true then its a terrible travesty and misuse of PQs,” he posted on Twitter.

While Ms Moitra has been quick to target the BJP leaders on X, formerly Twitter, over their allegations, she is yet to respond regarding Mr Hiranandani’s affidavit.

Regarding Mr Dubey’s letter to the Speaker, Ms Moitra had said she welcomes any kind of inquiry. She had also posted a strong denial of the IT minister’s allegations. “Sir, am member of IT Comm & JPC on Data Protection. This is valid question for all Indians. If hostile nation can steal data from apps – can’t they steal India user data stored overseas? Don’t insult my intelligence by alleging I’m fronting others. Something Ruia bag men do,” she had posted on X.
