New Delhi:

Religious sentiments can’t be hurt,  sources in government said today, explaining why the release date of Kangana Ranaut-starrer ‘Emergency’ was postponed. “Few religious organisations have raised concerns about this. Religious sentiments cannot be hurt. There is some sensitive content in the movie,” the sources said.

“The government is taking it (the concerns) seriously,” they added.

‘Emergency’, in which Ms Ranaut portrays former Prime Minister Indira Gandhi, was initially slated for release on September 6. However, its release date, postponed multiple times earlier, has been deferred again as the movie is yet to get a certificate from the Central Board of Film Certification (CBFC).

Several Sikh bodies have demanded a ban on the release of the movie, claiming it misrepresents the community. Top gurdwara body Shiromani Gurdwara Parbandhak Committee (SGPC) has sent a legal notice to the producers of ‘Emergency’, citing misrepresentation of the history of Sikhs and demanded the removal of the objectionable scenes that will hurt Sikh sentiments.

The BJP MP from Mandi – also the director, writer, and co-producer of ‘Emergency’ – termed the new development “hugely demotivating and unjust”.

Drawing parallels between her movie and Netflix series ‘IC814: The Kandahar Hijack’, she said censorship was only for those who make films based on “historic facts”.

“Law of the land is that one can show unimaginable amount of violence and nudity on OTT platforms without any consequence or censorship, one can even distort real-life events to suit their politically motivated sinister motives, there is all the freedom for communists or leftists across the world for such anti-national expressions,” she said.

Anubhav Sinha’s IC814 on the 1999 hijacking has courted controversy over the names of the hijackers. The government has summoned Netflix India’s content chief Monika Shergill over the row and sources said, “The government is taking it very seriously”.

Ms Ranaut, responding to a post by BJP leader Amit Malviya on IC814, wrote on X, “As a nationalist no OTT platform allows us to make films that revolve around the integrity and unity of Bharat, it seems censorship is only for some of us who don’t want tukde of this nation and make films on historic facts. It’s hugely demotivating and unjust.”

Last week, in a video message, the 38-year-old said that her film was still stuck with the censor board. She had also said she was under pressure not to show the assassination of the former prime minister by her security guards.

“This is an unbelievable time for me and I am very sorry for this state of things in this country,” she rued.

The CBFC has also received a legal notice from Shiromani Akali Dal (SAD) seeking to prevent the release of Ms Ranaut’s film, claiming it may “incite communal tensions” and “spread misinformation”.

The release of the period political drama was previously scheduled to be released on November 24, 2023.

The movie is facing the latest roadblock just a week after Ms Ranaut was reprimanded by the BJP leadership over her controversial remarks on farmers’ protest. “Kangana Ranaut is not authorised to speak on policy matters on behalf of the party and has not been given permission to do so. The BJP has directed Ms Ranaut to refrain from making such statements in the future,” the party said.

The BJP’s disapproval came after the BJP MP suggested that the farmers’ protest could have led to a Bangladesh-like crisis in India if not for the strong steps taken by the government.

The release of Kangana Ranaut’s new film “Emergency” has been postponed amid a huge controversy over the portrayal of the Sikh community in it. The release of the trailer had caused a furore in Punjab and the film is yet to get a green signal from the Certification Board. The film’s release was due on September 6, which has now been pushed back.

Sources said the film board has asked for more cuts. The board has said it would take into account the sentiments of every community.

Earlier, the Shiromani Akali Dal had sent a legal notice to the Board seeking to stop the release of the film, claiming it may “incite communal tensions” and “spread misinformation”.

“Such depictions are not only misleading but also deeply offensive and damaging to the social fabric of Punjab and the entire nation. It is apparent that Ranaut has chosen the subject of the Emergency not to make a genuine political or historical statement against Congress, but rather to target the Sikh community,” read the notice sent on August 27.

It also claimed the movie portrays the Sikh community in an “unjust and negative light”.

Ms Ranaut had earlier claimed that she was ready to go to court to defend the film.

“There is pressure on us to not show the assassination of Mrs Gandhi, Jarnail Singh Bhindranwale and the Punjab riots. I don’t know what we will show then…” she had said in a post on X, formerly Twitter.

“This is unbelievable time for me and I am very sorry for this state of things in this country,” she had said.

Keeping up its attack on the Congress over the Emergency, the government announced on Friday that June 25 will be observed every year as ‘Samvidhaan Hatya Diwas’, which loosely translates to ‘the day the Constitution was killed’. 

Making the announcement on X, Home Minister Amit Shah posted a gazette notification and wrote, “On June 25, 1975, the then PM Indira Gandhi, in a brazen display of a dictatorial mindset, strangled the soul of our democracy by imposing the Emergency on the nation. Lakhs of people were thrown behind bars for no fault of their own, and the voice of the media was silenced.”

“The Government of India has decided to observe the 25th of June every year as ‘Samvidhaan Hatya Diwas.’ This day will commemorate the massive contributions of all those who endured the inhuman pains of the 1975 Emergency,” he added.

PM Narendra Modi also posted on X and said the day will serve as a reminder of the Constitution being trampled over.

The Congress has hit back and accused the BJP of indulging in “yet another headline grabbing exercise in hypocrisy”.

‘400 Paar’ And Congress Claims

Throughout Narendra Modi’s tenure as Prime Minister, the Congress and other opposition parties have accused the BJP and the Central government of violating the Constitution as well as weakening constitutional institutions, including the election commission and the judiciary.

They got more ammunition when, in the months leading up to the 2024 Lok Sabha elections, Karnataka BJP MP Anantkumar Hegde and the party’s Meerut candidate Arun Govil, among others, said that the NDA had set itself a target of winning 400 seats because it wanted to amend the Constitution. 

The opposition, which had come together under the INDIA umbrella, seized on the opportunity to claim that the BJP wanted to end reservation and “dismantle” the Constitution. Congress leader Rahul Gandhi and others also began carrying a copy of the foundational document and stated repeatedly that the INDIA alliance was fighting to protect the Constitution. 

As the INDIA narrative began to gain traction, the BJP and the government went into damage-control mode, claiming that the opposition was spreading lies. The issue did, however, work to the INDIA alliance’s favour in several states and played a role in limiting the BJP to 240 Lok Sabha seats and the NDA to 293. 

Counter Attack

Going on the offensive, the BJP repeatedly brought up the Emergency to claim that it was the Congress that had violated the Constitution.

On June 25 this year, PM Modi led the attack, posting on X, “Today is a day to pay homage to all those great men and women who resisted the Emergency. The #DarkDaysOfEmergency remind us of how the Congress Party subverted basic freedoms and trampled over the Constitution of India which every Indian respects greatly.”

“Those who imposed the Emergency have no right to profess their love for our Constitution. These are the same people who have imposed Article 356 on innumerable occasions, got a Bill to destroy press freedom, destroyed federalism and violated every aspect of the Constitution,” he wrote, adding that the mindset which led to the imposition of the Emergency was “very much alive among the same party which imposed it”.

Amit Shah also tweeted that the Congress has a history of murdering democracy.

The Constitution and the Emergency also dominated the special session of Parliament, which began on June 24. Rahul Gandhi carried a copy of the Constitution with him while taking oath as an MP and his Congress colleague, Shashi Tharoor, said ‘Jai Samvidhan’ after he was sworn in. 

The Emergency was a part of President Droupadi Murmu’s address to a joint sitting of Parliament as well. 

“Today is 27th June. The imposition of Emergency on 25th June, 1975, was the biggest and darkest chapter of direct attack on the Constitution. The entire country felt outraged. But the country emerged victorious over such unconstitutional forces as the traditions of the republic lie at the core of India,” she had said, amid cheers from NDA members and protests by the opposition.

Rashtriya Janata Dal (RJD) Chief and former Bihar Chief Minister Lalu Prasad Yadav on Saturday recalled what they went through during the dark days of Emergency and said that the then Prime Minister Indira Gandhi put many of the leaders behind bars, but she never abused them.

In a post shared on X, the RJD chief shared an article “The Sangh Silence in 1975” written by him and journalist Nalin Verma. In the article, they attacked the BJP-led central government and said that although 1975 is a stain on the country’s democracy, let’s not forget who doesn’t respect the Opposition in 2024.

“I was the convener of the steering committee that Jayaprakash Narayan–had constituted to carry forward the movement against the excesses of Emergency imposed by the then PM Indira Gandhi. I was in jail under the Maintenance of Security Act (MISA) for over 15 months. My colleagues and I did not know many of the BJP ministers speaking about the Emergency today. We hadn’t heard of Modi, J P Nadda, and some of the PM’s other ministerial colleagues who today lecture us on the value of freedom,” he posted on X.

“Indira Gandhi put many of us behind bars, but she never abused us. Neither she nor her ministers called us “anti-national” or “unpatriotic”. She never enabled vandals to defile the memory of Babasaheb Ambedkar–the architect of our Constitution. 1975 is a stain on our democracy but let’s not forget who doesn’t respect the Opposition in 2024,” the RJD leader added.

On June 25, 1975, Indira Gandhi, the then Prime Minister, imposed a 21-month state of emergency. This year marks the 50th anniversary of the Emergency, which is considered one of the most controversial periods in India’s political history.

Earlier on Thursday, President Droupadi Murmu addressed the joint sitting of the Parliament and criticised the imposition of ‘Emergency’.

“Emergency was the biggest and darkest chapter of the direct attack on the Constitution. The entire country plunged into chaos during the Emergency, but the nation was victorious against such unconstitutional powers”, she said.

The remarks of the President have triggered reactions from the leaders of the INDIA bloc.

Congress National President Mallikarjun Kharge said that Prime Minister Narendra Modi is attempting to gain cheap applause by making the President deliver a speech filled with lies.

“Modi Ji is trying to gain cheap applause by making the Honorable President speak lies, which the people of India have already rejected in the 2024 elections,” Kharge wrote on his official ‘X’ account.

Union minister Jyotiraditya Scindia on Tuesday targeted Congress over the imposition of Emergency 49 years ago and claimed the voice of 80 crore people was stifled to save the chair of select people.

Speaking to reporters in Guna on the 49th anniversary of the Emergency, Mr Scindia said June 25 is remembered as a “black day” in the history of the country.

“Today is remembered as a black day as those elements had throttled the voice of 80 crore people to save their chair,” said Mr Scindia, a career Congress politician who quit the party in March 2020 and joined the BJP.

On the maiden visit to Guna after winning the recent Lok Sabha election on the BJP ticket, Mr Scindia said the electoral outcome has further strengthened democracy and the Constitution is being protected.

“The NDA (National Democratic Alliance) worships this ‘granth’” (Constitution),” he said.

Asked about his new responsibilities as the Minister for Communication and Development of the North Eastern Region, Mr Scindia said he would work with the same enthusiasm when he had handled the Civil Aviation portfolio.

He asked the Opposition to digest their electoral defeat instead of criticising the Central government.

“They should play the role of the opposition. But if you are unable to digest your defeat, then you will keep looking at power and remain in the opposition forever,” he said.

Mr Scindia attributed the BJP’s sweeping victory in all 29 Lok Sabha seats in Madhya Pradesh to Prime Minister Narendra Modi’s widespread popularity.

“PM Modi lives in the hearts of the people and vice-versa,” he said.

While he characterised the “Abki baar 400 paar” slogan as purely electoral, Mr Scindia noted that the “historic verdict” has cemented Modi’s position as Prime Minister for a third consecutive term.

“The victory of the BJP has three pillars: youth, women, and farmers,” he added.

Queried about fertiliser shortages, Mr Scindia assured that farmers would not face any difficulties.

“I have already sent two racks of manure this month and the third one will reach here by June 30th,” he said.

The “darkness” of the Emergency imposed by the Indira Gandhi-led Congress government in June 1975 “must be known to youngsters today as they are the future of the country”, former Vice President Venkaiah Naidu told NDTV Tuesday, on the 50th anniversary of that Emergency.

“I am very particular students today know what happened in the country in 1975… during the Emergency. They must know why it was imposed, how was it enforced, and how was it lifted. All of this must be known to youngsters because they are the future of the country,” Mr Naidu said.

Mr Naidu, a veteran member of the ruling BJP who was also a Union Minister, a Rajya Sabha MP, and the National President of his party, spent 17-and-a-half months in jail during the Emergency.

“I was sitting in a student meeting at the time. Suddenly a message came to me, saying. ‘Emergency is going to be imposed’. We were told, ‘please go underground’. That was the message…”

The message, Mr Naidu explained, came from the ABVP, or the Akhil Bharatiya Vidyarthi Parishad, the BJP’s youth wing. “It was then not a word familiar to us…” he chuckled.

“So I skipped away from the meeting, slipped to some other town, and changed my attire. For two-and-a-half months I avoided arrest and distributed pamphlets against the Emergency.”

“One day, as I was going back to Vijayawada to return a scooter belonging to my friend, the manager of a theatre in which I distributed pamphlets… he was my friend… he was telling the police, ‘you are searching for Venkaiah Naidu? That fellow is innocent. He does not know anything about all this’.”

Mr Naidu explained the police were waiting for him and he was swiftly arrested.

“The reason for my arrest was that I invited Jayaprakash Narayan (a prominent freedom fighter and political leader who opposed then Prime Minister Indira Gandhi) to the university. I was Chairman of the Students’ Union then… he came and addressed the students, and was very impressed.”

“I was then not in politics. I was arrested under MISA, or Maintenance of Internal Security Act.”

MISA was a controversial law passed by the then union government giving Mrs Gandhi and law enforcement agencies broad powers to detain individuals infinitely and without warrants.

“As a joke we used to call it ‘Maintenance of Indira Security Act’,” he smiled.

Earlier today Prime Minister Narendra Modi led the BJP’s charge and posted on X to mark the 25th anniversary of Emergency being declared, and took a sharp swipe at the Congress on this topic.

“Just to cling on to power, the then Congress government disregarded every democratic principle and made the nation into a jail. Any person who disagreed with the Congress was tortured and harassed. Socially regressive policies were unleashed to target the weakest sections,” he said.

The Prime Minister has referred to the Emergency multiple times this week, as the first session of the new Lok Sabha gets underway and the BJP and Congress prepare for a fierce squabble over various issues, including leaked exam papers for the UGC-NET and NEET-UG competitive tests.

On Tuesday too Mr Modi attacked the Congress on this subject, calling the Emergency a “black spot” on the history of India’s democracy.

The PM’s remarks drew a sharp response from Congress president Mallikarjun Kharge, who said Mr Modi spoke about a 50-year-old period but disregard the last decade’s “undeclared Emergency”.

The BJP eased to a third consecutive term after the April-May-June general election on the back of a strong show by National Democratic Alliance partners.

The BJP won only 240 seats – 32 short of majority – but 53 from the NDA, including 28 from Chandrababu Naidu’s TDP and Nitish Kumar’s JDU, ensured a third straight win for Mr Modi’s party.
