Hemant Soren was summoned multiple times by the ED (File)

The Enforcement Directorate (ED) has moved the Supreme Court challenging the Jharkhand High Court’s order granting bail to JMM leader Hemant Soren in a money laundering case linked to an alleged land scam.

The high court had on June 28 granted bail to Mr Soren, who on July 4 took oath as the chief minister of Jharkhand.

Mr Soren, the executive president of the Jharkhand Mukti Morcha (JMM), had resigned as chief minister shortly before his arrest on January 31 by the ED in the case.

Earlier during the hearing in the high court, ED’s counsel had argued that if Mr Soren was released on bail, he might commit a similar offence and referred to cases against ED officers in the SC/ST police station.

“Though the conduct of the petitioner has been sought to be highlighted by the Enforcement Directorate on account of the First Information Report instituted by the petitioner against the officials of the ED, but on an overall conspectus of the case, there is no likelihood of the petitioner committing a similar nature of offence,” the high court had said.

The single bench order had also mentioned that the consequence of the findings recorded by the court “satisfies the condition as at section 45 of the Prevention of Money Laundering Act, 2002 to the effect that there is reason to believe that the petitioner is not guilty of the offence as alleged”.

Mr Soren was summoned multiple times by the ED before being questioned at his residence and subsequently arrested on January 31.

Union Minister Shivraj Singh Chouhan on Friday criticised Jharkhand Chief Minister Hemant Soren for replacing tribal leader Champai Soren as Chief Minister, alleging that the move was driven by a desire for ‘dynastic control’.

Speaking in Ramgarh, Mr Chouhan accused Mr Soren of prioritising the interests of a single family.

“What was the fault of Champai Soren? You made him the Chief Minister, you could have let him continue, but you removed a tribal Chief Minister. Just because you want to have the hold of just one family…,” Mr Chouhan said.

Meanwhile, during his visit to Ramgarh, Jharkhand, the Union Minister interacted with locals, who shared that while housing approvals under the rural housing scheme have been granted and the installments received, they are still facing issues due to the “policies and corruption of the Soren government in Jharkhand”.

The locals further said, “the sand, which should cost Rs 3,300, is now priced at Rs 5600, making it unaffordable. This significant increase in the price of materials like sand and bricks is creating difficulties in constructing their homes”.

On July 4, Hemant Soren was sworn-in as the 13th Chief Minister of Jharkhand in Raj Bhavan, Ranchi.

Earlier in the day, Mr Chouhan said that significant change in Jharkhand will be seen in the upcoming assembly elections, with the Bharatiya Janata Party (BJP) poised to form a government by defeating the “corrupt, dishonest, and chaotic” current government.

“Now the biggest thing is that the real change will happen in the Assembly elections, the corrupt, dishonest, and chaotic government will go and the BJP will come,” Mr Chouhan said.

Speaking during his visit to Ramgarh, Chouhan emphasised the BJP’s commitment to ending the misrule of the coalition government in Jharkhand. He highlighted the state’s vast potential and called Jharkhand a “wonderful state.”

“I am fortunate to have had the opportunity to come to this holy land of Jharkhand. It is our resolve to end the misrule of the coalition government here. It is a wonderful state and has tremendous potential. The soul of the BJP is our ideology – the philosophy of integral humanism and workers are our life,” Mr Chouhan said.

Mr Chouhan also shared his experiences of visiting and having breakfast with party workers, stating that these interactions brought him great joy.

Further slamming the current government in Jharkhand, the Union Minister said that the state is in very bad condition and the “coalition government is destroying and ruining Jharkhand”.

“The situation that I have seen and the things that the party workers have told me, Jharkhand is in a bad condition; it’s loot everywhere. Seeing this fills my heart with pain. This coalition government is destroying and ruining Jharkhand. This is a government that has not fulfilled a single promise,” Mr Chouhan said.

Mr Chouhan expressed concerns over increasing infiltration in Jharkhand, warning that it jeopardises the state’s future. He promised that the BJP would end the current misgovernance and establish effective governance once again.

“Our workers are filled with enthusiasm. The people are living in a chaotic situation, and they have made up their minds to uproot this coalition from Jharkhand and bring in the BJP,” Mr Chouhan said.

During his visit, Mr Chouhan also engaged with women of Self Help Groups (SHGs) at a panchayat secretariat in Ramgarh. He praised their efforts towards realizing Prime Minister Modi’s vision of ‘Lakhpati Didi’ and acknowledged PM Modi’s initiative to build houses for extremely backward castes.

“Women are working very hard to fulfil PM Modi’s vision of ‘Lakhpati Didi’…PM Modi decided to build houses for extremely backward castes…” Mr Chouhan said.

Meanwhile, in the village of Sugia, a group member proudly showcased handmade brass utensils, mentioning that they fetch a good price in the market. During this time, Lakhpati Didi Sushila presented the Union Minister for Rural Development with a handmade traditional Jharkhandi cap.

The floor test of the new government in Jharkhand, led by Chief Minister Hemant Soren, who took the oath of office for the third time on Thursday, will be held on July 8 during a special session of the Jharkhand Legislative Assembly.

Mr Soren, on June 28, was released on bail in a land scam case after spending around five months in jail.

Champai Soren resigned from the post just five months after taking the oath, setting the ball rolling for Hemant Soren to again take over the role on Wednesday. Champai Soren took oath as the 12th Chief Minister of Jharkhand in the Raj Bhavan on February 2 this year.

Hemant Soren was released from the Birsa Munda Jail on June 28 after nearly five months following bail from Jharkhand High Court in a money laundering case linked to an alleged land scam. He had resigned as Chief Minister before his arrest on January 31.

He was arrested by the Enforcement Directorate (ED) in January on charges related to an alleged land scam and money laundering. Earlier on December 29, Hemant Soren took the oath as Chief Minister of Jharkhand as the 11th Chief Minister of Jharkhand.

The event was termed as ‘Sankalp Diwas’ by mark the beginning of an era of new Jharkhand.Hemant Soren’s return as CM will bolster the JMM, which won three seats in the tribal-dominated state of Jharkhand in the Lok Sabha elections.

In 2019, JMM fought the assembly elections in alliance with the Congress and Lalu Prasad’s Rashtriya Janta Dal (RJD) and got a comfortable majority with forty-seven seats in the 81-member house.

Hemant Soren and Champai Soren attended the meeting of the ruling coalition today

Hemant Soren is set to take over as Jharkhand Chief Minister again after the alliance of the Jharkhand Mukti Morcha (JMM), Congress and the RJD elected him leader, paving the way for his return to the top post.

Hemant Soren had stepped down as Chief Minister in January before he was arrested by the Enforcement Directorate in a money laundering case. He was granted bail last week. The JMM leader has denied all charges.

All is, however, not well. Champai Soren, who had taken over as Chief Minister after Hemant Soren stepped down, is not happy with the decision to replace him, sources have said. Champai Soren, it is learnt, may be named JMM’s executive president.

At the meeting of JMM’s legislature party, Champai Soren said he was feeling “insulted”, the sources said. The party, however, went ahead and named Hemant Soren its legislature party leader.

Champai Soren may submit his resignation to the Governor this evening, setting in motion the process for Hemant Soren to take over.

Leaders of the ruling coalition reached a consensus on Hemant Soren’s return during a meeting at Champai Soren’s residence today. The meeting was attended by Congress’ Jharkhand in-charge Ghulam Ahmad Mir, state president Rajesh Thakur and Hemant Soren’s wife and MLA Kalpana Soren.

Speculation regarding a change of guard were triggered after all important programmes of Chief Minister Champai Soren were cancelled today.

Elections in Jharkhand are months away and the JMM is looking at fighting the polls with Hemant Soren as its face. But the decision to replace Champai Soren will provide the Opposition BJP with ammunition in the run-up to the polls and strengthen its dynasty narrative.

Setting the tone for the BJP’s offensive, Nishikant Dubey, party MP from Jharkhand’s Godda, said in a social media post that the “Champai Soren era is over in Jharkhand”.

Targeting the JMM, he said, “In the family-oriented party, people outside the family have no political future. I wish the chief minister drew inspiration from Bhagwan Birsa Munda and stood up against the corrupt Hemant Soren ji.”

Champai Soren, 67, is a veteran leader of the JMM and has been with party founder and Hemant Soren’s father Shibu Soren for decades now. Earlier, he was a cabinet minister in the Hemant Soren government.

Elections in Jharkhand are likely to be held around November.

A day after he was released on bail, having spent five months behind bars following his arrest by the Enforcement Directorate in a land scam case, former Jharkhand chief minister Hemant Soren has hit out at the BJP for “framing” him and said the people of the state will give the party a befitting reply in the Assembly elections, due later this year.

In an exclusive interview with NDTV on Saturday, the Jharkhand Mukti Morcha leader also played down his struggles and said his father, former chief minister and party chief Shibu Soren and others in his party have had to face much worse.

Attacking the BJP over his arrest, Mr Soren repeated a charge that has been lobbed often at the ruling party and claimed that it was misusing agencies. Stating that the action against him is proof that the voices of the poor, tribals and farmers are being suppressed, he said the people of the state have seen everything and will make their displeasure known in the elections, likely to be held around November.

Jharkhand is ruled by a coalition led by the JMM, which has 27 MLAs, followed by the Congress, which has 18 in the 81-member house. The alliance, part of the larger INDIA bloc, also includes the RJD and the CPI (Marxist-Leninist) Liberation, which have one seat each.

Asked about his time in prison, the JMM leader said, “Our party chief Shibu Soren and many other leaders of the party have fought an even harder battle, this is nothing in front of them. Now we are on the frontlines and I have also got an opportunity to understand things and understand conspiracies (plotted against us).”

On the cases in which he is named, he said, “The court has given an order, it is available online. Look at that and assess how the voices of the poor, Dalits, backwards and farmers are being suppressed. These five months that I was in jail… for a poor person, a farmer, every moment and every hour is precious.”

His, Wife’s Future?

After Mr Soren’s arrest, the party’s number three, Champai Soren, became chief minister. This followed rumours of Hemant Soren’s wife, Kalpana, taking the reins, and his sister-in-law, Sita Soren, also quit the party ahead of the Lok Sabha elections amid a perceived power struggle.

To a question on whether he would become chief minister again, Mr Soren said, “I will look at all of this later. I just came out yesterday. I am with the party workers and am being welcomed by them. My beloved workers have reposed their trust in me and I am sharing in their enthusiasm. I am not looking at the government or the party for now. All of this will be seen in the time to come and will be communicated to you”

Kalpana Soren played an active role when Mr Soren was behind bars and also attended INDIA alliance meetings. When the JMM leader was asked about her future role, he said,  “She is my wife and we are from a political family. My father has been in politics and so have my elder brother, my wife and I. Our opponents will call it dynastic politics, but I will only say everyone should work according to their capacity.”

Jharkhand CM Hemant Soren: JMM leader Soren gets bail from High Court (File).

Ex-Jharkhand Chief Minister Hemant Soren has been granted bail by the High Court. “Bail is granted. The court held, prima facie, Hemant Soren is not guilty, and there is no likelihood of the petitioner committing an offence on bail,” Mr Soren’s counsel Arunabh Chowdhury, told news agency PTI.

The Jharkhand Mukti Morcha leader was arrested by the Enforcement Directorate on January 31 on money laundering charges. The ED has accused him of running a scheme to manipulate records, via fictitious transactions and forged documents, and acquire 8.86 acres of land in Ranchi worth crores.

The bail order today comes after a twin setback last month.

First, the Ranchi special court denied Mr Soren bail.

Then, in the Supreme Court, the Jharkhand leader was forced to withdraw an interim bail plea after tough questions over non-disclosure of facts; the focus was on Mr Soren not revealing the special court – which hears cases related to money laundering – had taken cognisance of the complaint against him.

There was also confusion over a prior bail plea – dismissed – in the High Court, which then pointed to an “abundance of documents that lay foundation for the arrest and remand of petitioner”.

This was after the Supreme Court issued a notice to the central agency and sought its response to an interim bail plea filed before it on grounds the High Court was delaying delivery of its judgement.

The Supreme Court setback meant Mr Soren – unlike Aam Aadmi Party leader and Delhi Chief Minister Arvind Kejriwal, arrested by the ED in the alleged liquor policy scam – could not campaign for his party, and the Congress-led INDIA opposition bloc, in the April-June Lok Sabha election.

Mr Kejriwal had been granted bail by the top court to campaign for the AAP.

Hemant Soren resigned as Chief Minister on January 31, hours after the ED began a marathon questioning session and then informed him he would be arrested.

Hemant Soren interim bail plea: Hemant Soren was arrested in January

New Delhi:

The Supreme Court on Friday disposed of the petition of former Jharkhand Chief Minister Hemant Soren seeking interim bail to campaign for the ongoing Lok Sabha elections.

The Supreme Court said that Mr Soren’s interim bail petition should be taken up along with the petition declaring his arrest in a money laundering case as “illegal”, due for hearing on Monday.

The Jharkhand Mukti Morcha (JMM) leader was arrested in January by the Enforcement Directorate (ED) in a money laundering case linked to an alleged land scam. He had moved the Supreme Court against the Jharkhand High Court order dismissing his application challenging his arrest by the ED and denied bail to him.

Senior advocate Kapil Sibal, who appeared for Mr Soren, told a three-judge bench headed by Chief Justice D Y Chandrachud that polling for the ongoing Lok Sabha elections in Jharkhand will commence on May 13 and that the JMM leader should be allowed to campaign for his party.

“Hemant Soren was arrested on January 31. We moved the high court on February 4. The high court reserved the judgment on February 28 but did not deliver the judgment. The High Court kept the judgment pending for long,” Mr Sibal said.

“The first phase of election starts in the state on May 13 and so we moved this court under Article 32 of the Constitution, and notice was issued last week. After the notice was issued, the high court delivered the judgment rejecting his plea. Its very unfortunate that rights are being trampled in this fashion,” Mr Sibal had said.

Mr Soren was arrested on January 31 shortly after he resigned as the Jharkhand chief minister. He is currently lodged in judicial custody at the Birsa Munda Central Jail in Ranchi.

The central probe agency has alleged that “huge amounts of proceeds of crime” were generated by Mr Soren through manipulation of official records by showing dummy sellers and purchasers in the guise of forged/bogus documents to acquire huge parcels of land having value in crores of rupees.

JP Nadda hit out at Hemant Soren for his alleged “appeasement policy”

Virtually launching the campaign for the 2024 Lok Sabha elections in Jharkhand, BJP national president JP Nadda on Saturday attacked Chief Minister Hemant Soren accusing him of causing the most damage to tribals despite being a tribal and being “neck-deep” in corruption.

Addressing a rally here, JP Nadda claimed that ED, CBI and other agencies are “chasing the Soren government” as it is patronising land, sand and other mafias.

“The enthusiasm of people proves that they have taken a pledge to help the lotus bloom here again. Corruption has grown exponentially under Hemant Soren. The Jharkhand chief minister has been indulging in vote bank politics,” JP Nadda told a public rally here.

The rally marks the closure of the BJP’s Sanklap Yatra with a resolution to free Jharkhand from “hunger, corruption and misrule”.

“He (Hemant Soren) talked about tribals and sought their votes, but caused the maximum damage to the interest of tribal people. For vote bank politics, he has given consent to religious conversions in Jharkhand. His vote bank should remain intact, no matter where the culture of the tribal people goes,” the BJP president claimed.

People of Jharkhand need to understand that when the BJP comes to power, it serves the people but when JMM and Congress are in power, they become busy filling their own coffers, and “those who join them are hounded by ED and CBI,” he claimed.

Hitting out at Hemant Soren for his alleged “appeasement policy”, he sought to know why no action was taken when temples were vandalised.

“The police have become ‘bhakshak’ (oppressor) from ‘rakshak’ (saviour)… Jungle Raaj is prevailing in Jharkhand,” the veteran BJP leader said.

He claimed that under the BJP rule, left-wing extremism was in control but it has increased manifold at present.

Hemant Soren, the executive president of JMM, became the chief minister after a coalition led by his party defeated the BJP in the 2019 assembly elections. The Congress and the RJD are the alliance partners of the JMM.

The JMM-led government in Jharkhand is patronising land, sand and other mafias, JP Nadda alleged.

Referring to a case of alleged irregularities in a mining case, he asked people whether they had seen any chief minister who got a tender in his name and dared Hemant Soren to prove him wrong.

Speaking about various projects of the central government, JP Nadda claimed that their implementation is slow in Jharkhand.

He said that in 2014, the length of national highways in the state was 2,402 km which is 7,791 km now.

Road construction work worth Rs one lakh crore is being undertaken in Jharkhand, JP Nadda said.

The Deoghar AIIMS was constructed at Rs 1,100 crore in four years and the railway station and the airport in Ranchi were developed, he said.

The high court will again hear the matter after six weeks (File)

Ranchi:

The Jharkhand High Court on Tuesday stayed the proceedings against Chief Minister Hemant Soren at a court in Jamshedpur, which was hearing a case registered in 2014, accusing him of model code of conduct violation.

A bench of Justice Sanjay Kumar Dwivedi said that no coercive steps can be taken against Mr Soren, directing the state government to file a reply in the matter.

Mr Soren had challenged in the high court the proceedings pending against him at the Jamshedpur court, arising out of a case registered in the Adityapur police station during the 2014 assembly elections.

The high court will again hear the matter after six weeks.

Mr Soren has been accused of violating the model code of conduct as he campaigned beyond the stipulated time for the candidate of his party, the JMM.

The high court had in 2022 quashed another similar case against him. In that case, Mr Soren was accused of wearing a sash with the JMM logo while going to cast his vote during the 2019 assembly polls.

Chief Minister Hemant Soren on Saturday filed a petition in the Jharkhand High Court challenging issuance of summons to him by the Enforcement Directorate (ED) in a case of alleged money laundering, his counsel said. The Supreme Court on September 18 had refused to entertain Soren’s plea against the ED’s summons in a case of alleged money laundering. A bench of Justice Aniruddha Bose and Justice Bela M Trivedi granted Soren the liberty to approach the Jharkhand High Court for relief in the matter.

Soren filed the petition in the high court challenging the issuance of summons to him by the ED, Soren’s counsel Piyush Chitresh said.

The ED had sent a summons to Soren to depose at the federal agency’s office in Ranchi on August 14 and later to record his statement under the Prevention of Money Laundering Act.

Soren had also skipped the ED’s summons in an alleged defence land scam case citing pre-scheduled events.

The 48-year-old Jharkhand Mukti Morcha leader was interrogated for over nine hours by the ED on November 17 last year in connection with another money-laundering case linked to alleged illegal mining in the state.

The central probe agency is investigating more than a dozen land deals, including one related to defence land, wherein a group of mafia, middlemen and bureaucrats allegedly connived to forge deeds and documents of as long back as 1932.

The ED has arrested several people so far in the state, including Soren’s political aide Pankaj Mishra.

Soren was initially summoned by the ED on November 3, 2022, but he did not appear citing official engagements. He had even dared the central probe agency to arrest him and then sought a three-week deferment of the summons.

While the ruling JMM has alleged that the CM is being made a political victim, the BJP last week said with the “kind of corruption” he has committed in the state, Soren will not get any relief from any court and he will have to eventually face an Enforcement Directorate probe.
