Supreme Court allowed sub-categorisation of Scheduled Castes and Scheduled Tribes reservations

Chandigarh:

The Haryana cabinet chaired by Chief Minister Nayab Saini in its first meeting today decided to formally accept the Supreme Court’s decision regarding the sub-categorisation of Scheduled Castes (SC) and Scheduled Tribes (ST) reservations and implement it immediately.

The decision will ensure a fair distribution of benefits within the existing reservation system, it said.

Currently, there is a 15 per cent reservation for SC and a 7.5 per cent reservation for ST. With this decision, Haryana will be able to allocate specific quotas within this 22.5 per cent reservation to those sub-groups within SCs and STs that have lesser representation in employment and education.

The Supreme Court on August 1 ruled that a sub-classification would be permissible within reserved category groups for providing benefits of affirmative action. A seven-judge Constitution bench headed by Chief Justice of India DY Chandrachud overturned the 2004 judgment of a five-judge Constitution bench, which barred preferential treatment to certain sub-castes, holding that the members of the SCs and STs form homogeneous groups incapable of further regrouping or classification.

However, in 2020, a five-judge bench headed by Justice Arun Mishra (now retired) opined that the ruling is required to be revisited by a larger bench, as the benefit of reservation is not percolating down to the neediest and poorest of the poor.

In its first meeting, held a day after taking the oath of office, the Haryana cabinet announced free dialysis for patients suffering from severe kidney diseases in all government hospitals in the state.

“The first file that I signed after assuming charge was regarding the decision pertaining to kidney patients. We had also made this promise in the elections. The cost of dialysis is nearly Rs 20,000 to Rs 25,000 per month. Now, the Haryana government will bear the expenses,” Mr Saini said.

On government job recruitments, Mr Saini slammed the previous Congress government, accusing it of treating job distribution as a business. Regarding the assembly session, he said the cabinet discussed the matter, and a date would be finalised, post-festive season, within one to two days.

Mr Saini, who warned criminals to either leave the state or face strict action, reassured farmers that every grain of their crop would be purchased at the minimum support price (MSP).

Emphasising transparency, he recalled his promise of creating 50,000 jobs, with 15,000 already provided and 25,000 more planned. He assured that job recruitment would be conducted without any monetary transactions. He assured that all existing welfare schemes would continue without interruption.

Nayab Singh Saini will take oath as the Chief Minister of Haryana.

Panchkula (Haryana):

Haryana Chief Minister designate Nayab Singh Saini on Thursday offered prayers at Valmiki Temple in Panchula on the occasion of Maharishi Valmiki Jayanti ahead of his oath-taking ceremony.

Speaking on the occasion, Nayab Saini said, “It is a matter of good fortune for me that today is the birth anniversary of Lord Valmiki. He worked to end the evils prevalent in the society and gave a message to the society. Today it is my good fortune that I have got the opportunity to worship at the feet of Lord Valmiki. I extend my heartfelt congratulations and best wishes to all the people of the state on his birth anniversary.”

Further, speaking on the formation of the government, Nayab Saini said, “This double engine government along with PM Narendra Modi will work to take Haryana forward at a fast pace.

He also highlighted that today, the people who have put their faith in BJP is the result of Modi ji’s policies.

“I thank the people of Haryana. Today people are getting jobs in Haryana government without any ‘Kharcha or Parcha’. This has instilled confidence in the youth,” Saini said.

Speaking about NDA leaders attending his oat-taking ceremony, Nayab Saini said that it is a matter of pride.

“It is a matter of pride that senior leaders of NDA and Chief Ministers of NDA ruled states will be attending today’s function,” he said.

Haryana BJP president Mohan Lal Badoli asserted that today will be a historic day in Haryana politics.

“In the presence of Prime Minister Narendra Modi, BJP will form the government for the third time in Haryana and Nayab Singh Saini will take oath as Chief Minister for the second time. Chief Ministers, Union Ministers and senior NDA leaders will be present on this occasion. This is a very historic day because today is also the birth anniversary of Lord Valmiki,” Badoli said.

Mr Saini will take the oath of office, marking a new chapter for Haryana. The ceremony is scheduled to occur in Panchkula, with all NDA leaders invited to witness the event.

Following the ceremony, a crucial NDA meeting will be held in Chandigarh from 3 PM to 5 PM.
Prime Minister Narendra Modi will address the meeting of the National Democratic Alliance (NDA) in Chandigarh, coinciding with the swearing-in ceremony of Haryana’s upcoming Chief Minister Nayab Singh Saini on Thursday.

West Bengal Governor CV Ananda Bose, Chhattisgarh Chief Minister Vishnu Deo Sai, Tripura CM Manik Saha arrived in Chandigarh to attend the swearing-in ceremony of Haryana CM-designate Nayab Singh Saini.

Nayab Singh Saini was on Wednesday chosen as the leader of Haryana BJP Legislature Party in a meeting chaired by Union Home Minister Amit Shah in Chandigarh.

The BJP is set to form its third successive government in Haryana after it won 48 seats in the 90-member assembly as per the results announced last week. The Congress won 37 seats.

Haryana Assembly Election Result 2024: The BJP is poised for a third straight win in the state

The BJP in Haryana will cross 50 seats and form government for the third time, party leader Yogeshwar Dutt told NDTV as the ruling party pulled a rabbit out of its political hat and stunned its principal rival, the Congress, and defied the exit poll predictions, which were not so kind to it.

Leading in 50 seats (out of 90), the BJP looks set to return for a third term, a feat not heard of before in the state. The majority mark is 46.

“Everybody knows how Congress, two days before results, tried to create an atmosphere. We have been saying from the start that we will form the government. You wait and see, we will cross 50 seats and form a government for the third time, which will be a historic achievement,” said Mr Dutt in Hindi.  

“The people of Haryana have shown that they are with the BJP. That they are with an imaandaar (honest) party,” he added, showering praise on the good work done by Chief Minister Nayab Singh Saini and his predecessor ML Khattar.

Asked about Vinesh Phogat, who making her poll debut won from Julana, Mr Dutt said ,”The question is who is forming the government. These few wrestlers – Bajrang Punia, Sakshee Malikkh and Vinesh Phogat – have tried to spoil the atmosphere in Haryana. The Haryana public has answered them. Whether Vinesh wins or loses is not important, if you look at other 89 seats, these wrestlers have had no effect. Haryana does not have just three wrestlers,” said Mr Dutt, an Olympic bronze-medallist, who had to sit out this election.

Pressed to answer what’s next for him, the BJP leader said,”I am happy. It is for the party to decide who should get a ticket. I am with a nationalist party an will remain so.”

Lagging behind, the Congress questioned the Election Commission over its slow pace of counting.

A buoyed BJP has called a meeting of its leaders at the residence of Nayab Singh Saini, who won his seat from Ladwa.
