NEET-UG 2024 was held on May 5 and attended by nearly 24 lakh aspiring medical professionals

The Supreme Court on Thursday heard a clutch of petitions seeking re-test or cancellation of the 2024 NEET-UG – for entrance to undergraduate medical courses – and raised concerns over the stand of the Centre and the National Testing Agency (NTA) — the body that conducts the nationwide exam — that the paper leak happened only about 45 minutes before the start of the exam in certain centres.

The results of the 2024 NEET-UG exam, which was held on May 5 and attended by nearly 24 lakh aspiring medical professionals, have been plagued by allegations of leaked question papers and incorrectly awarded ‘grace marks’.

Solicitor General Tushar Mehta, who represented the NTA, submitted that as per the CBI investigation, at a particular centre in Jharkhand’s Hazaribagh, a person unauthorizedly took photographs of the question papers between 8 AM and 9.20 AM on the day of the exam. The CBI has been tasked with investigating the case.

A bench headed by Chief Justice DY Chandrachud wondered if all the 180 questions could have been solved within 45 minutes, given that the examination started at 10.15 AM, to which Mr Mehta replied that there were seven persons in the gang who divided the questions among themselves.

“Whole hypothesis that within 45 minutes there was a breach and the entire paper was solved and given to students seems very far-fetched,” Chief Justice Chandrachud said.

These question papers were then solved and the students, who allegedly paid the gang, were given the answers to memorize.

At the outset, the bench, also comprising Justices JB Pardiwala and Manoj Misra, said it has prioritised the hearing on the petitions over other cases as these have “social ramifications” and lakhs of students are waiting for the outcome.

After the day-long arguments concluded, the next date was set as July 22.

Exam Body’s Defence In Supreme Court NEET Case

Senior advocate Narender Hooda, appearing for some of the petitioners, vehemently sought cancellation of the NEET-UG 2024 claiming “systemic failure” in holding it.

He alleged that the transportation of question papers was compromised and that they were in the custody of a private courier company for six days in Hazaribagh. Shockingly, he claimed, they were transported in an e-rickshaw to an exam centre whose principal later got arrested for alleged involvement in the racket.

Solicitor General Tushar Mehta, however, refused any suggestion of the NEET-UG 2024 paper leak and pointed out the CBI had investigated the chain “from printer to centre”.

“How the sealing happened… how GPS tracking happened… There is a seven-layer security system,” he told the court.

The court then asked Mr Mehta, “Mr Solicitor… did you engage a private courier company to dispatch the NEET papers?”. The Solicitor General deferred his reply to a later stage.

Questions over transportation were flagged after the CBI suggested a leak – either while the papers were being taken to centres or after they arrived at one – a school in Hazaribagh.

NEET-UG Re-Test Only If “Sanctity” Lost

During the hearing, the Supreme Court stressed it would only order a NEET-UG 2024 re-test if the “sanctity” of the May 5 exam was “lost on a large scale” as a result of leaked questions.

The remark was an echo of observations made last week, when the court said the “sanctity” of the exam had been affected and demanded answers. The top court then, however, had advised against a re-test, saying certain circumstances would argue against it.

“You have to show us that the leak was systematic… that it affected the entire examination… so as to warrant cancellation of the entire exam…” Chief Justice Chandrachud told senior advocate Narender Hooda, who appeared for the petitioners.

When Mr Hooda informed the court that around 23.33 lakh students appeared for the exam for about 1.08 lakh seats in government and private medical colleges, the bench said, “Merely because out of 23.33 lakh only 1.08 lakh students will get admission, we cannot order a re-test. Re-examination has to be on a concrete footing that the entire exam is affected.”

NEET-UG 24 Controversy

Controversy over the NEET-UG 2024 broke last month after allegations the question paper had been leaked – subsequent inquiries indicated the leak was orchestrated by a national ‘solver gang’ network – on social media.

The first red flags were the unusually high number of perfect scores. A record 67 students, including six from one coaching centre, scored a maximum of 720.

Questions were also asked over the award of ‘grace marks’ – not exam protocol, according to the authorities – to 1,563 students.

In an affidavit filed last week, the government, referring to the analysis by IIT Madras insisted there is no indication of “mass malpractice” nor evidence that some candidates had benefitted from cheating.

Neet UG Exam Row: The NEET-UG exam was held on May 5 (File).

New Delhi:

The 2024 NEET-UG – for entrance to undergraduate medical courses – can only be conducted again if the “sanctity” of the test held on May 5 was “lost on a large scale” as a result of leaked questions the Supreme Court said Thursday morning as it heard over 40 petitions asking for a re-test.

The remark was an echo of observations made last week, when the court said the “sanctity” of the examination had been affected and it demanded answers from the authorities. The court then advised petitioners against a re-test and said certain circumstances would argue against that measure.

The court also heard petitions from the under-fire NTA – the National Testing Agency, the central body responsible for the conduct of competitive exams – seeking transfer of cases filed by various state police forces to the respective High Courts to avoid potential duplication and confusion.

“You have to show us that the leak was systematic… that it affected the entire examination… so as to warrant cancellation of the entire exam…” a bench led by Chief Justice DY Chandrachud said, “Merely because, of 23 lakh (students) only one lakh will get admission… we cannot order a re-examination.”

“Second, tell us what should be the direction of the investigation in this matter.”

“If we accept your wider submission (that leaked question papers compromised the exam results) we would also like your assistance on the lines on which the investigation must happen.”

The court also pointed out it may be unfeasible to identify and “segregate” the hundreds, or thousands, of students who may have conspired to access questions beforehand.

‘1.08 Lakh vs 24 Lakh’ Question

On the numbers of petitioners – seen as crucial to establish the strength of petitions seeking cancellation – the NTA responded, “There are 131 not within the 1.08 lakh (students selected for admission to private colleges) who want a re-test and there are 254 who are opposing the re-test.”

The question of data and how to analyse this data was an early bone of contention, with senior advocate Narender Hooda, for the petitioners, complaining of a “handicap”.

“I am starting with a handicap. I do not have the results… because of that I cannot have the data analytics,” he told the court, as he also pointed out a possible conflict of interest. He said, “One of the Directors of IIT Madras is a member of the governing body of the NTA…”

Appearing for the agency, Solicitor General Tushar Mehta countered quickly. “This is factually wrong. Somebody else was…” he said, and explained, “Governing body has no role in conduct of exam.”

On IIT Madras’ Data Analysis

Returning to the question of analytics, Mr Hooda argued it would be difficult to establish variances given a data set as large as all students who took the exam, i.e., nearly 24 lakh. The NTA, in a written submission to the court last night, said data analysed by IIT Madras showed mark distribution followed a bell-shaped curve normal to any large-scale examination, and indicated no abnormality.

The report also acknowledged the “overall increase in marks obtained… specifically in the range of 550 to 720… across cities and centres” and attributed it to a “25 per cent reduction in syllabus”.

Mr Hooda, however, said that report was based on the figure of nearly 24 lakh and that the analysis should have been carried out on the 1.08 lakh students who passed the examination.

“Data analytics was run for 23 lakh students… but at what stage, if 10,000 or 20,000 (cheated) can you detect abnormality? The correct procedure was to apply this to 1.08 lakh…”

“The (bell-shape) curve is no indication there is no abnormality because the data is too large… which cannot be caught. Granular variations can’t be seen with this large data…” he insisted.

100 Toppers

Mr Hooda also demanded the NTA release data for the top 100 ranks and not just the top 17; the IIT Madras report showed a city-wise list, which showed the maximum (five) came from Bengaluru, with four from Lucknow and three each from Kota in Rajasthan and Tamil Nadu’s Namakkal.

The Chief Justice subsequently read out the list of top 100 students, which showed there were nine toppers from Rajasthan alone and six from Bahadurgarh in Haryana.

Mr Hooda pointed out what he said was an anomaly, but the NTA said the list’s purpose “is to show toppers are spread over… that there is no abnormal spike in any particular centre.”

The incident also triggered a political row, with the Congress-led opposition attacking the ruling BJP in Parliament, forcing ruckus and chaos as MPs debated the Motion of Thanks to President Droupadi Murmu’s joint address.

NEET-UG Exam Row: The petitions want the medical entrance exam to be reconducted

The Supreme Court is hearing a batch of petitions related to the controversy-ridden medical entrance exam NEET-UG 2024, which was held on May 5. The Supreme Court has said the re-examination can only be done on a concrete footing that sanctity has been lost on a large scale.

A bench comprising Chief Justice of India (CJI) D Y Chandrachud and justices JB Pardiwla and Manoj Misra commenced the crucial hearing, saying that it has “social ramifications”. It also asked petitioners to show the paper leak was “systemic” and affected the entire examination, warranting cancellation.

The bench is hearing more than 40 petitions, including those filed by the National Testing Agency (NTA), seeking the transfer of cases pending against it in various high courts on the NEET-UG row to the Supreme Court to avoid multiplicity of litigations.

New Delhi:

A man who stole NEET-UG paper from the trunk of the National Testing Agency in Bihar’s Hazaribagh before they were allegedly leaked and his associate has been arrested by the CBI today, sources said. Pankaj Kumar, who stole the paper, has been arrested from Patna while Raju Singh was caught in Jamshedpur.

Mr Kumar aka Aaditya did his civil engineering from NIT Jamshedpur in 2017, the sources said. His accomplice Raju had allegedly distributed the leaked paper, they said.

 Leak Had Genesis In Hazaribagh: CBI

The Central Bureau of Investigation (CBI) had earlier zeroed in on Hazaribagh as the origin place of the NEET-UG paper leak. The paper was leaked by Oasis school in Hazari Bagh, the CBI probe said, adding, that two sets of papers which reached there had their seals broken and instead of flagging the issue the staff of the school remained tight-lipped.

“Nine sets of question papers were dispatched from SBI Hazaribagh to different centres. The ones that reached Oasis school centre had their seals broken. The staff there did not raise an alarm and thus, their role is established,” a senior official disclosed.

“Based on technical evidence, they had made searches in Learn and Play School in Patna where some burnt papers were recovered,” he explained adding that the case was later taken over by the Bihar Economic Offences Unit (EOU).

On June 21, the NTA disclosed that the code matched the papers found in Oasis school, he added.

Interestingly, the principal of the school, Dr Ehsanul Haque, was also the district coordinator for the NEET-UG exam in Hazaribagh and vice-principal Imtiaz Alam was the centre coordinator. 

The CBI, which is probing the alleged irregularities in the medical entrance exam, has registered several First Information Reports (FIRs) and made nearly 60 arrests so far. 

The NEET-UG exam – conducted by the National Testing Agency for admissions to MBBS, BDS, AYUSH and other related courses in government and private institutions – was held on May 5 this year. The exam has been mired in controversy, with allegations of cheating and impersonation. The CBI FIR from Bihar pertains to paper leaks, while those registered in Gujarat, Rajasthan and Maharashtra, are linked to the impersonation of candidates and cheating.

This year, the exam was conducted on May 5 at 4,750 centres in 571 cities, including 14 abroad. More than 23 lakh candidates had appeared for the test.

67 Students Scored Perfect 720

Sixty-seven students had scored a perfect 720 in this year’s exam, unprecedented in the NTA’s history, with six from a Haryana centre figuring in the list, raising suspicion about irregularities in the examination. It was alleged that grace marks contributed to the 67 students sharing the top rank.

The number of candidates sharing the top rank was reduced to 61 from 67 as the NTA announced the revised results on July 1 after conducting a retest for 1,563 candidates. Forty-eight per cent of students who were scheduled to retake the exam on June 24 did not turn up. Of the total, 813 (52 per cent) gave the retest and 750 skipped, the data released by the NTA showed.

The exam has also been riddled with allegations of paper leaks which are being probed by the CBI.

The Rouse Avenue court on Friday granted bail to one Gangadhar Gunde whose counsel claimed that he was wrongly arrested by the CBI due to mistaken identity in an NEET paper case linked to Latur, Maharashtra.

CBI had arrested the accused Gunde on June 26 from Dehradun. This case was initially registered by the Latur Police at Shivaji Nagar Police Station. Later on, the FIR was taken over by the CBI.

Special CBI judge Ankit Singla granted bail to Gangadhar Gunde after hearing arguments of counsel for CBI and the accused.

He has been granted bail on furnishing of a bail bond of Rs 25,000 and a surety bond of the same amount.

Advocate Kailash More counsel for Gangadhar Rangnath Gunde argued that Gunde had been arrested by the CBI on June 26 from Dehradun due to mistaken identity. He is not the actual man for whom CBI was looking for.

It was also submitted that an FIR was lodged by the CBI about the NEET UG exam 2024 against a person whose name is also Gangadhar but the full name was not revealed. N Gangadhar Appa Nanjuthappa was arrested by the CBI later on.

CBI had lodged the case against unknown persons. N Gangadhar Appa Nanjuthappa has been arrested in Bengaluru.

Advocate More also submitted that Gangadhar Gunde’s name surfaced during the investigation as he met one Sanjay Tukaram Jadhav on October 2.

Gunde met him in Osmanabad about his daughter’s matrimonial dispute at her in-law’s house. There Gunde and Jadhav exchanged their mobile numbers. Gunde made a call to Jadhav on October 3, the bail plea stated.

On the other hand, the counsel for the CBI disputed the submissions of the defence counsel. She argued that one suspect Irenna Konagalwar is on the run and only knows who is actual Gangadhar agency was looking for. So as far now, it can’t be said with surety that the present accused is not the same Gangadhar agency was looking for.

Relying upon the statement of arrested teachers Sanjay Tukaram Jadhav and Jalil Umar Khan Pathan, CBI submitted that Konagalwar knew Gangadhar.

She further pointed out that they have arrested another accused N Gangadhar Appa Nanjuthappa. It was also submitted that the mobile number CBI had was being used by Gunde. Jadhav and Gunde had a conversation.

CBI counsel also submitted that Gangadhar has been arrested in the initial FIR registered on June 23, 2024. His name surfaced during the interrogation of Sanjay Tukaram Jadhav and Jalil Umar Khan Pathan, the FIR named the accused persons.

Counsel for CBI submitted in the court that Gandhar has been arrested on the basis of complaint given by the Inspector ATS Maharashtra police against four persons including Gangadhar. The Complaint had his name and his number and he is Delhi Delhi-based person.

Another man N Gangadhar Nanjuthappa also has been arrested.

One accused namely Irenna Konagalwar is on the run, only he can identify who is real Gangadhar, the agency looking for, CBI counsel submitted.

It was also submitted that Gangadhar’s phone CDR is also awaited.

While referring to the conspiracy aspects the CBI counsel submitted that Jadhav and Pathan were contacting and collecting initial token money and admit cards from the NEET Aspirants. They were sending the same to Irenna Konagalwar who in turn gave it to Gangadhar who lives in Delhi to get their marks increased.

It is also submitted that Gunde was arrested on the intervening night of June 25 and 26 in Dehradun in one of the five cases registered by the CBI. He was produced before the Rouse Avenue Court on June 27 and was remanded to CBI custody till June 30. Thereafter he was sent to judicial custody on July 12.

The Central Bureau Of Investigation (CBI) on Tuesday arrested two more persons in Patna in the National Eligibility-cum-Entrance Test (Undergraduate) 2024 paper leak case; one was identified as a candidate named Sunny Kumar, a resident of Nalanda, while the other was Ranjit Kumar, father of another candidate from Gaya, said agency sources.

The Kuki Inpi Manipur (KIM), apex body of Kuki tribes in Manipur, on July 9 called for a 12-hour shutdown across all Kuki-Zo dominated districts of the State over the arrest of five purported village volunteers from their community by the security forces in the last two days, with some women’s groups of the Kuki-Zo community alleging that personnel of the security forces had beaten local women who were protesting the detention.

Parliament Session Live: This is the first session after the constitution of the 18th Lok Sabha.

Parliament Session 2024 LIVE Updates:

Amid student protests over alleged irregularities in the medical entrance exam NEET (National Eligibility cum Entrance Test) and other competitive exams, the opposition INDIA bloc will raise the issue in both houses of Parliament today. 

The Opposition will try to corner the government even though the day is dedicated to a discussion on the Motion of Thanks to the President’s address to Parliament.

In case the matter comes up today, Education Minister Dharmendra Pradhan will respond to it, sources said.

In her address to the joint sitting of Parliament on Thursday, President Droupadi Murmu said the government is fully committed to investigating the recent incidents of paper leaks and ensure that the guilty are punished.

This is the first session of Parliament after the constitution of the 18th Lok Sabha.

Speaking on the alleged NEET paper leak case, Congress MP Rahul Gandhi today said that the Parliament should send message to youth that the government and opposition are together in raising concerns of students.

“There should be a discussion on NEET here in the House. I request the Prime Minister that this is an issue of the youth and it should be discussed properly and it should be a respectful discussion. We will do it respectfully. You should also join the discussion, you should also participate because this is a matter of the youth. A message should go from the Parliament that the Indian government and the opposition are talking about the students together,” he told reporters outside Parliament.
